1. On 9 January 2014, a three- ~member panel of the Board
consisting Of )iiajgjadiiiimeliiaipebiaaaetiae =. Guus ee oem 8
ae. considered the enclosures and determined that the
partial corrective action listed below should be taken on
the evidence of record.
CONCLUSION:
Upon consideration of all of the evidence of record, and
particularly in view of the comments contained in enclosure (2),
the Board finds the existence of an injustice warranting
corrective action.
RECOMMENDATION:
a. That Petitioner’s naval record be corrected to show that on
17 April 2007, the Secretary of the Navy found him unfit
for duty due to chronic back pain which was rated at 0%
disabling under Department of Veterans Affairs code 5237;
accordingly, the Secretary directed that Petitioner be
discharged by reason of physical disability on 18 April
2007 under the provisions of 10 U.S. Code 1203, with
entitlement to disability severance pay
c. That no further relief be granted.
4. It is certified that a quorum was present at the Board's
review and deliberations, and that the foregoing is a true and
complete record of the Board's proceedings in the above entitled
matter.
